Service.

Pulse is designed to monitor websites and help identify failures affecting their availability or functionality.

Depending on the selected plan and configuration, Pulse may provide functionality including:

• HTTP and availability monitoring.
• Page content and string checks.
• SSL certificate monitoring.
• Domain-related monitoring.
• Website crawling.
• Automated browser journey testing.
• Website functionality checks.
• HTML snapshots and other diagnostic information.
• Automated retesting.
• Forms and booking-flow testing.
• Alerts and notifications.

Available features, limits and monitoring frequencies may vary between plans. Features described as planned, in development or coming soon, such as the Transaction plan, are not part of any current subscription.

Monitoring checks currently run from servers in the United Kingdom, so monitored websites will receive requests from UK network addresses.

Pulse is intended to assist with detecting website problems. It cannot guarantee that every fault, outage, defect, failed transaction, security issue or loss of functionality will be detected.

Monitoring occurs at particular intervals and under particular technical conditions.

A website may behave differently:

• Between monitoring intervals.
• For different users.
• On different devices or browsers.
• From different geographic locations.
• Under different network conditions.
• When interacting with third-party services.

A successful Pulse check means that the configured test succeeded under the conditions and at the time at which it was performed.

It does not guarantee that the relevant website or functionality was continuously available before or after the check.

Customers remain responsible for the operation and availability of their websites and services.

Automated monitoring may occasionally produce false positives or false negatives.

Pulse may identify a failure when functionality remains available to genuine users. Conversely, Pulse may successfully complete a test while a problem affects some genuine users.

Customers should independently investigate significant alerts where appropriate.

Pulse should not be treated as the sole control for systems where a failure could cause substantial financial, safety or other critical consequences.

You may only use Pulse to monitor, crawl, test or interact with websites and systems that you own or that you have appropriate authority to test.

By configuring a website or system within Pulse, you confirm that you have sufficient authority to instruct Pulse to perform the configured monitoring.

You must not use Pulse to:

• Test systems without authorization.
• Circumvent access controls without appropriate authority.
• Interfere with third-party systems.
• Perform attacks.
• Generate deliberately disruptive traffic.
• Collect information unlawfully.
• Otherwise use the service for unlawful or abusive purposes.

We may suspend monitoring where we reasonably believe activity is unauthorized, unlawful, abusive or harmful.

Pulse may use automated browsers to reproduce actions performed by genuine website users.

Websites and their dependencies can change at any time.

Changes to page structure, selectors, content, JavaScript, authentication, cookie interfaces, anti-automation mechanisms, booking platforms or other third-party functionality may cause an existing browser journey to stop functioning correctly.

We do not guarantee that synthetic journeys will remain compatible following changes to the website or its dependencies.

Where appropriate, Pulse may attempt automated retesting or customers may be required to update or reconfigure a journey.

Certain Pulse plans may test website forms, booking systems and other transactional functionality.

Where configured, Pulse may submit test information or create test records in systems designated by the customer.

Where supported, Pulse may subsequently attempt to remove, cancel or otherwise clean up test records.

We do not guarantee that third-party systems will successfully remove every test record.

Customers using these features are responsible for ensuring that:

• They are authorized to permit the testing.
• Test submissions will not create inappropriate legal, financial or operational consequences.
• Appropriate test data and configuration are supplied.
• Testing does not improperly consume genuine appointments, inventory or other limited resources.
• Any relevant third-party service permits the interaction.

Pulse will not intentionally complete genuine financial purchases unless such functionality is expressly offered and separately agreed.

Websites monitored by Pulse may rely upon third-party services including hosting providers, content delivery networks, APIs, booking platforms, payment providers and other integrations.

We do not control those services and cannot guarantee their availability, security, behavior or compatibility.

A third-party change or outage may affect Pulse monitoring or produce an alert.

Pulse may notify customers about detected failures through email or other supported notification methods.

Notification delivery cannot be guaranteed.

Messages may be delayed or prevented by circumstances including email-provider failures, spam filtering, network problems or outages affecting third-party notification services.

Customers should consider additional monitoring or notification mechanisms where immediate awareness of an outage is business-critical.

You are responsible for maintaining the confidentiality of your account credentials and for activity performed through your account.

You must provide accurate information and take reasonable precautions against unauthorized access.

Please contact NEKAI promptly if you believe your account has been compromised.

We may invalidate sessions, require credential changes or temporarily restrict access where reasonably necessary to protect the service or its users.

Monitoring frequency, available functionality and usage allowances may vary according to your selected Pulse plan.

The applicable features and price will be displayed when purchasing a subscription or otherwise agreed with you.

Reasonable technical limits may be applied to protect Pulse and its infrastructure from excessive or abusive usage.

If usage substantially exceeds that reasonably contemplated by a subscription, we may contact the customer regarding an appropriate plan or usage arrangement.

The free monitoring offer is provided at no charge, may be limited to one website per customer and may be changed or withdrawn at any time.

Paid subscriptions are billed monthly or annually, as you choose at checkout. The price, currency, billing period and any website discount are shown before you pay.

Customers using our US pages are charged in US dollars (USD). Customers using our UK pages are charged in pounds sterling (GBP). You may buy in either currency wherever you are located. Your bank or card issuer may charge its own fees for payments in a foreign currency.

Displayed prices include any taxes we are required to charge on the subscription. We do not add tax on top of the displayed price at checkout.

Payments are processed by our payment provider, Stripe. By subscribing, you authorize Stripe to charge your selected payment method for each billing period until your subscription ends. We do not receive or store your full card number.

If a payment fails, we may retry it and may pause paid monitoring until the outstanding amount is resolved.

Paid subscriptions renew automatically. Unless you cancel, your subscription continues and your payment method is charged at the start of each new monthly or annual billing period.

Each renewal is charged at the price that applies to your subscription at that time. If we change the price of your subscription, we will tell you by email before the change takes effect, and you may cancel before the next renewal if you do not wish to continue.

You can view your subscription, payment method and invoices in the billing portal available from your Pulse account.

You can cancel at any time. Sign in to Pulse, open Plan and billing, and choose to manage your billing. This opens the secure Stripe billing portal, where you can cancel your subscription. You can also ask us to cancel it by emailing us.

Cancellation takes effect at the end of your current billing period. You will not be charged again, and paid monitoring continues until that period ends.

Payments already made are not refunded for the remainder of a billing period, except where required by applicable law or where we agree otherwise.

We aim to operate Pulse reliably but do not guarantee uninterrupted or error-free availability.

Pulse may occasionally become unavailable because of:

• Maintenance.
• Software defects.
• Infrastructure failures.
• Security incidents.
• Third-party service failures.
• Network disruption.
• Circumstances outside our reasonable control.

We may perform maintenance and make reasonable changes to the service where necessary.

Pulse is an actively developed product.

We may add, modify or remove functionality as the product develops.

We will aim to provide reasonable notice where a material change substantially reduces functionality included in a paid subscription, where reasonably practicable.

Features described as beta, experimental, preview or similar may be less reliable and may change or be withdrawn.

Customers should not rely exclusively on experimental functionality for business-critical operations.

All intellectual property rights in Pulse and the NEKAI service, including software, interfaces, designs, documentation, branding and underlying technology, remain with their respective owner.

NEKAI™ and Pulse™ are trademarks of NEKAI. Registration is pending; they are not registered trademarks.

While your account is active, you are granted a limited, non-exclusive and non-transferable right to use Pulse for legitimate internal or business purposes in accordance with these Terms.

You may not copy, resell, reproduce, reverse engineer or attempt to obtain Pulse source code except where such a restriction is prohibited by law.

You retain ownership of your websites, content and information supplied by you.

You retain any rights you hold in information and content supplied by you.

You grant the rights reasonably necessary for Pulse to access, process, reproduce and temporarily store website content for the purpose of performing the monitoring you request.

Pulse may generate monitoring results, logs, performance information and diagnostic information.

Aggregated or appropriately anonymized information may be used to operate, secure, analyze and improve Pulse where it does not identify customers or individuals.

Personal information will be handled in accordance with the NEKAI Privacy Policy and applicable data protection law.

Where personal information is processed by NEKAI solely on a customer’s behalf, separate data-processing terms may apply.

Customers are responsible for ensuring that they have an appropriate lawful basis and any necessary notices or permissions for the monitoring they configure.

You must not use Pulse:

• Against systems you are not authorized to test.
• To distribute malware.
• To conduct denial-of-service or other attacks.
• To unlawfully bypass authentication or security controls.
• To harass another person or organization.
• For unlawful surveillance.
• To infringe intellectual property rights.
• To process information unlawfully.
• To intentionally interfere with another service.
• For any purpose prohibited by applicable law.

Accounts may be suspended or terminated for material breaches of this section.

Access to Pulse may be suspended or terminated where reasonably necessary because of:

• Non-payment.
• Material breach of these Terms.
• Unlawful or abusive activity.
• A security threat to Pulse or other users.
• Use that creates unreasonable technical risk.
• A legal or regulatory requirement.

Where reasonably possible, we will attempt to contact the affected customer before termination for a remediable breach.

Pulse is a monitoring tool.

We do not guarantee that using Pulse will prevent downtime, lost bookings, lost inquiries, lost sales, lost revenue, reputational harm or any other business loss.

Pulse identifies certain technical conditions according to the checks and schedule configured for your website. It does not repair websites, and it cannot detect every problem that may affect your customers or your business.

We may update these Terms as Pulse, our business or the law changes. The latest version will be published on this page with the date of the most recent update.

Where a change materially affects an active paid subscription, we will aim to tell you by email before it takes effect.
